i really hope the guy he's talking about, complaining about him everywhere, isn't our limbo-love. when i looked at the tribe moderators thread it seemed like there were a few people who were annoyed by him, not just one. -

What's amazing to me are all the cites TOU-guy is making per the TOU, but this condition is not covered specifically in the TOU. Read it....it's right in the lower righthand corner of each and every screen!

Wed, May 5, 2004 - 3:19 PMI started talking to DR coincidentally the first day he created the account. It coincided with Thad leaving, so I sent him a message asking if he were Thad. He responded no, but that he wished he could figure out a way to capitalize on it. This started a stream of e-mails back and forth between us. Now I get the occasional message (got two the other day), that were reposts. He just recently started reposting to me. I don't respond to those. -

Fri, May 7, 2004 - 1:25 PMReally, there aint a godamned thing Tribe can do about it. First, Tribe does not specifically say what is permitted and what isn't. Deleting the account without written, citable cause in a published TOU amounts to censorship. Tribe uses the word "publish" about posting in the existing TOU. To censor a "published work" amounts to a first amendment violation unless it is exempt speech (hate, violates law, etc.,) or violates a predefined set of rules agreed to by the account holder.
Lastly, if Tribe did delete his account, there is nothing to prevent him from creating it again...again, and again.
There's a phrase, "choose your battles carefully." It holds here. Nuking 419 spammers, and those that break the laws or harrass must take priority. Nuking an "annoyance" is blatent subjective censorship, and starts a slippery slope of catering to special interests which will render Tribe useless. -
